The operative parties referred to in this policy are MGCSpace (MGCyber Tech Creations) and you, the user of this site. MGCSpace is the publisher and operator of the web site www.mgcspace.com. MGCSpace's Acceptable Use Policy (the "Policy") for MGCSpace Services is designed to help protect MGCSpace, MGCSpace's customers, and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by MGCSpace. MGCSpace reserves the right to modify the Policy at any time, effective upon posting at https://mgcspace.com/legal/aup .
Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. MGCSpace does not actively monitor dedicated server content for review. MGCSpace believes in the free dissemination of information via our services. Dedicated server content will only be reviewed upon complaint by verified third parties. Content that does not violate local, state and internatinal law or the AUP is deemed in compliance and shall remain intact.
Sending Unsolicited Bulk Email ("UBE", "spam") : The sending of any form of Unsolicited Bulk Email through MGCSpace servers is prohibited. Likewise, the sending of UBE from another service provider advertising a web site, email address or utilizing any resource hosted on MGCSpace servers, is prohibited. MGCSpace accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider. ANY form of spamming activity (e.g. mail spam, Usenet spam, pop-up spam, selling/buying spamware, and so on) conducted ANYWHERE on the Internet, i.e. whether through our facilities or not, will be:
Running Unconfirmed Mailing Lists: Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by MGCSpace Hosting customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any MGCSpace hosted domain, or referencing any MGCSpace Hosting account, is prohibited.
Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.
Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org/rokso .
Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking"). MGCSpace reserves the right to report illegal activities to any and all regulatory, administrative, and/or governmental authorities for prosecution. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any MGCSpace customers or end-users by any means or device.
Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the MGCSpace services, network or on another provider's network.
Using MGCSpace Services to interfere with the use of the MGCSpace network by other customers or authorized users.
In addition to above mentioned Accpetable Use Policy, following also apply to Shared Hosting Services provided by MGCSpace including VPS, reseller hosting, shared hosting.
MGCSpace offer some plans and services with with features like but not limited to Unlimited Disk, Unlimited Bandwidth, Unlimited Email Accounts, Unlimited Databases, Unlimited FTP accounts etc. Unless not mentioned in plan you opted, we do not impose any limit on amount of resources you use as long as you comply with this Agreement. However, in the event your service usage or content presents a risk to the stability, performance or uptime of our servers, data storage, networking or other infrastructure, you may be required to upgrade to a more powerful solution such as VPS or Dedicated server, or we may take action to restrict the resources your website is utilizing.
At MGCSpace.com, we deploy series of methods to give our users best possible experience for the products and servies we offer. However, in case of shared hosting environment, a portion of users can not utilize all resources or unfairly or adversely impat the experience of other users. Our shared hosting environment is best optimized for typical requirements of small and medium sized websites and application. For large scale application, enterprises Shared Hosting is NOT a suitable solution, for such use case, VPS or Dedicated servers must be used as their resources are generally dedicated to assigned user.
For users with legit growing demand and increased traffic, we provide to give them more resources by moving them to bigger or more optimized servers as long as their website or application complies with this AUP. In order to protect experience of all users of shared hosting server, MGCSpace deploy automated metchanism to throttle, temporary disable resources for users impacting the server until the said user or website is not analyzed by MGCSpace.
Each MGCSpace customer is responsible for the activities of its users and, by accepting service from MGCSpace, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of an MGCSpace customer will be forwarded to the MGCSpace customer's postmaster for action. If violations of the MGCSpace Acceptable Use Policy occur, MGCSpace reserves the right to terminate services with or take action to stop the offending customer from violating MGCSpace AUP as MGCSpace deems appropriate, without notice.
We reserve the right to refuse, cancel or suspend service at our sole discretion. All Sub-Networks, distributive hosting sites and dedicated servers of MGCSpace must adhere to the above policies. Failure to follow any term or condition will be grounds for immediate account deactivation without refund.
